Inscrite dans la lignée des travaux menés dans le domaine des déclamations juridiques pour réévaluer les interactions entre rhétorique judiciaire et droit romain, la présente étude examine la controversia 9, 3 de Sénèque le Père comme une source-clé d’arguments pouvant contribuer à une meilleure connaissance du développement historique de l’édit du préteur en matière de vis et metus. L’hypothèse soutenue est que l’originalité marquée par cette déclamation concerne précisément deux phénomènes juridiques : les conventiones sine nomine et l’actio praescriptis verbis. L’objectif poursuivi est de montrer que les traces de l’évolution conceptuelle subie par la clause quod metus causa, telles qu’elles apparaissent dans le traitement de l’expositio opéré par la controversia 9, 3, éclaircissent le problème du consentement forcé dans la protection judiciaire des conventions synallagmatiques atypiques au cours du premier siècle de l’Empire.
In line with, and in complement to, the works carried out in the field of forensic declamations with a view to reevaluating the interactions between judicial rhetoric and Roman law, this paper examines Seneca the Elder’s controversia 9, 3 as a key source of arguments that can contribute to a better understanding of the historical development of the praetorian edict on vis and metus. It is argued that the originality marked by this declamation relates precisely to two legal phenomena: the conventiones sine nomine and the actio praescriptis verbis. The overall aim is to show that the traces of the conceptual evolution undergone by the clause quod metus causa, as reflected in the treatment of expositio given by controversia 9, 3, clarify the problem of forced consent in the judicial protection of atypical synallagmatic conventions in the first century of the Empire.
